Barry C. Toone, J.D., Project Director and Lead Attorney, Elder Care Injury (ECI)

Barry C. Toone is a seasoned trial attorney and nationally recognized leader in product liability defense and elder care injury litigation. As Project Director and Lead Attorney of Elder Care Injury (ECI), a specialized practice group within Eisenberg Lowrance Lundell Lofgren, Barry brings a rare combination of defense-side industry insight and plaintiff advocacy to protect vulnerable adults in nursing homes and assisted living facilities throughout Utah and the Mountain West.

Barry earned his Juris Doctor, cum laude, from Notre Dame Law School, where he served as Senior Editor of the Notre Dame Law Review and was recognized as a James A. Pindar Scholar. He graduated summa cum laude from Weber State University with a Bachelor of Integrated Studies in English and Philosophy.

Barry’s career spans nearly three decades. He began in Phoenix at Snell & Wilmer, defending global manufacturers in catastrophic injury and product liability cases. He later joined Bowman and Brooke LLP, where he became one of the firm’s youngest managing partners. For more than ten years, he led the Phoenix office and represented Fortune 500 clients including Ford, Toyota, Honda, Volvo, Mazda, and Polaris in complex product safety litigation across the country.

Repeatedly recognized by Super Lawyers for excellence in Product Liability Defense and Health Care Law from 2008 through 2022, Barry has since focused his practice on nursing home negligence and Medicaid financing integrity. He has become a leading voice for elder care accountability and oversight in Utah and has been featured by Fox13, ABC4, and KUER (NPR) for his analysis of Utah’s Upper Payment Limit (UPL) program. Drawing on years of experience defending the nursing home industry, Barry now advocates exclusively for victims of elder neglect and abuse, combining deep regulatory knowledge with trial experience to hold facilities accountable and restore dignity to those they serve.

Barry is licensed to practice in Utah, Arizona, Texas, and Missouri. He has litigated extensively in both state and federal courts, including the Ninth Circuit Court of Appeals and the U.S. District Courts of Arizona, Texas, and Utah.

Beyond his legal practice, Barry serves as Founder and Director of Professional Relations at 1st Watch Wellness, a leading provider of proactive mental health and wellness programs for first responders. He also lectures on professional ethics, recovery from chemical dependence, and engineering ethics in product design at the University of Utah’s College of Engineering.

In his personal time, Barry enjoys spending time with his wife, children, and grandchildren and remains a proud—if sometimes irrational—supporter of Notre Dame football.
