Utah Amazon Delivery Accident Lawyers
Serving South Jordan, Salt Lake City, Sandy, Draper, West Jordan, and Communities Throughout Utah
Amazon delivery vans operate on every residential street in the Salt Lake Valley. Drivers work against tight route times, make dozens of stops an hour, and watch an Amazon hand held device between stops. When an Amazon driver causes a crash, the injured person faces something more complicated than an ordinary car accident claim: It involves a web of contractors; delivery companies; and insurance policies built to shield Amazon from fault.
At Eisenberg Lowrance Lundell Lofgren, we cut through that structure. For over thirty years our trial lawyers have represented thousands of injured Utahns, and we know how to identify every party and every policy that is directly and vicariously responsible for the driver that hurt you.

Who Is Driving That Amazon Vehicle?
The first question in any Amazon crash is who employed the driver, because that answer decides which companies and insurers are responsible. Amazon delivers packages through several different programs:
- Delivery Service Partner (DSP) drivers. Most blue-gray Amazon Prime vans are driven by employees of a Delivery Service Partner, a separate company that contracts with Amazon to deliver packages from Amazon delivery stations. Amazon takes the position that DSPs hire and manage their own drivers. The DSP carries its own commercial auto policy, and Amazon's contracts commonly require the DSP to defend and indemnify Amazon.
- Amazon Flex drivers. Flex drivers are gig workers who deliver in their own personal cars, with no Amazon logo on the vehicle. Amazon provides Flex drivers a commercial auto policy with $1,000,000 in liability coverage, but only while the driver is actively delivering during a scheduled delivery block. Outside that window, the driver's personal policy may be the only coverage, and many personal policies exclude delivery work.
- Freight and Relay carriers. Box trucks and tractor-trailers hauling Amazon freight are often operated by independent trucking companies. These crashes also implicate federal motor carrier safety rules for driver qualification, hours of service, and vehicle maintenance.
A Flex driver on an active block, a DSP driver on an assigned route, and a freight carrier hauling for Amazon each present a different set of challenges with at fault defendants and insurance policies. Insurance adjusters count on injured people not knowing the difference.
Can Amazon Be Held Responsible?
Amazon structures its delivery network so that someone else employs the driver. That label by Amazon, i.e., independent contractor, does not end the self-serving label. Utah law looks at who controls the work.
Amazon assigns the routes, sets delivery targets, supplies the packages and often the vans, requires its uniforms and branding, and tracks drivers through its own cameras and apps, which monitor speed, braking, phone use, and other driving behavior. Aggressive and smart litigation can demonstrate how Amazon controlled how the driver did the job, If sufficient facts are established during the discovery process of litigation, Amazon can be responsible alongside the delivery company.
Juries in other states have reached that conclusion. However, each case turns on its own facts, and verdicts in other states does not predict the outcome of any other case here in Utah. They do show that Amazon's contractor structure can be tested in front of a jury, and that the evidence of control cab be established in Amazon's own records.
Depending on the facts, responsible parties in an Amazon delivery crash can include:
- The driver
- The Delivery Service Partner that employed and trained the driver
- Amazon and its logistics subsidiaries
- The owner or lessor of the delivery vehicle
- A freight carrier or vehicle maintenance company
- Another negligent driver
